JOB PURPOSE

Reporting to the Commercial Director, the Commercial Manager will provide pre and post-signature, broad commercial support to the business in supporting public and private sector clients through effective management of risk across the supply chain.

To have a working knowledge of contract law in order to provide advice and guidance on contractual risk and commercial viability of contracts to the Directors and senior management team. To provide advice on existing contractual issues and in relation to new contracts, both with the client and suppliers, to advise on current and future relationships with respect to financial exposure and contractual risk.

To negotiate with the client on amendments within delegated limits to the existing partnership contract to ensure equitable and balanced business relationships can be formed without undue risk to either party.

To construct contract clause amendments and appropriate pricing and operational delivery schedules to define the nature and extent of contracts. The incumbent will need highly developed verbal and written communication skills, together with good numeracy skills and MS Office product knowledge.

Ensure that contracts with third party suppliers, finance lease providers and internal Capita Group companies include an appropriate flow down of obligations from the primary client contract and acting as the authorised representative of the Commercial Director in the role as Contract Manager of relevant key sub-contractors.

To provide advice to the operational managers on the commercial risks associated with day to day issues that arise during the operation of the service.

The roles will primarily support either Capita’s Workplace Technology or Intelligent Communications business but will also be required to provide support to the wider Specialist Division where required.

KEY RESPONSIBILITIES

To review and advise upon liabilities in new and existing contracts.

Day to day management of bids and contract changes + commercial management of projects.
*

Negotiation with client and third-party suppliers and finance providers to ensure the company are not exposed to an unacceptable level of commercial risk.
*

To escalate issues relating to exposure of commercial risk to the Commercial Director and designated authority within the business.
*

Negotiate with external and internal clients to identify and eliminate exposure to risk and drive best value for money.
*

Management of the Deliverables and Obligations Tracker to ensure that Capita is meeting its contractual obligations.
*

Management of existing suppliers to ensure flow down and continued adherence to terms and conditions thereby ensuring Capita continues to meet its obligations with its client contracts. Such other duties and responsibilities as may be required of the employee, that are commensurate with their knowledge, skill and experience.
